3 Things You Should Do Before You File A Personal Injury Lawsuit

If you have been considering a personal injury lawsuit for wrongs done against you, it is important that you take the necessary steps to make sure that you are going about the process right. Here are some things that you need to do to make sure that you are taking the right steps.

1. File A Claim With Your Insurance

Before you take any legal action you need to try to work it out with your insurance first. In many cases just making a claim and working it out with the insurance provider will be all that you need to do to get restitution for your problems.

The issue arises when you make a claim and it is denied, or if the insurance provider gives you the run around. If they take months to get back to you or keep making you go to different departments with not results, then you need to take legal action. In some rare cases insurance companies may drag out the process so that the person cannot file a lawsuit, so if it has been months and nothing has gotten taken care of, you need to talk to an attorney.

2. Gather All Documents

Before you meet with the lawyer for a consultation you need to have all of the proper documentation together. Included in your portfolio should be any records pertaining to the incident. If there was a police report, photos, witness reports and so forth you need to get a copy and bring them with you.

In addition, you need to bring all documentation relating to the injuries that you sustained. If you had medical bills bring all the receipts, insurance claims, physical therapy bills, and doctors records. Next, you should gather all information that could prove lot wages if applicable. This could be W-2 records, old pay stubs, taxes, and any proof of lost wages and time of work because of the incident. Lastly, any personal property that you need to replaced should also be included. Bring receipts or proof of current market value of the property that has been damaged.

3. Be Ready To Settle

It is important that before you go into the lawsuit that you have the mindset to settle. If the attorney writes a demand letter and you get a reasonable offer from the other party, be ready to accept it. A lawsuit shouldn't be used as a way to punish someone else or to get revenge. Instead, it should be a way to get restitution for your damages.

By understanding these things you can be more prepared for a personal injury lawsuit.
